How Often do Plaintiffs Win Medical Malpractice Trials?

Medical malpractice trials are difficult to win. While you may have read newspaper headlines of million-dollar jury verdicts, the reality is that the majority of Plaintiffs who take their medical malpractice case to trial actually lose their cases and receive nothing. In a 2008 study which was published by the United Stated Department of Justice, Bureau of Justice Statistics, it was reported that in medical malpractices cases which are actually decided by a jury, it is highly likely that the verdict will be in favor of the doctor or medical facilities; in fact, the win rate for medical malpractice Plaintiffs in that study showed there was less than 25% chance of a favorable verdict. In a more recent study published by the National Institutes of Health, a review of 20 years of data found that physicians win 80% to 90% of jury trials in which the Plaintiff’s evidence is weak, 70% of jury trials in which the Plaintiffs evidence is borderline, and half of all jury trials even where there is strong evidence of medical malpractice against them. And, according to data published on MedPage Today for those medical malpractice cases that reach a jury 79.6% of the verdicts favor the physician.
